Terms of Service.

Agreement and Acceptance

By accessing or using postedby.ai or the PostedByAI service, you agree to these Terms of Service and our Privacy Policy. If you use the service on behalf of a business, you represent that you have the authority to bind that business to these terms.

The Service

PostedByAI is a content execution system — not a tool you manage. It creates a Champion voice profile, generates strategic authority content engineered for SEO, AEO, and GEO, and publishes it automatically to your connected platforms every week. The service is provided on an as-is and best-effort basis.

Your Account

• You must provide accurate and current information.
• You are responsible for maintaining the security of your account and connected platforms.
• You are responsible for all actions taken under your account.
• You must be at least 18 years old and authorized to act for your business.

Fees and Billing

• Monthly billing begins once your first posts are live.
• Payment is processed via Stripe, including card or ACH where available.
• Failed payments may result in service pause after 7 days and account termination after 30 days.
• Onboarding fees are non-refundable.
• Unpublished content does not incur charges.

Content Ownership

• The client owns generated content once published.
• The client retains ownership of their business information, Champion description, and brand materials they provide.
• postedby.ai retains ownership of the service infrastructure, AI Champion voice methodology, templates, prompts, and aggregate de-identified performance data.

Acceptable Use

You may not use the service to generate content that is illegal, fraudulent, deceptive, defamatory, harassing, discriminatory, hateful, infringing, or otherwise unlawful. You may not use the service to create misleading medical, financial, or legal advice presented as professional counsel, or politically divisive content outside a normal business context.

Hosted Blog Content

Weekly articles generated for your account are published publicly on postedby.ai at the URL path /blog/[your-company]/[slug]. By using the service you authorize postedby.ai to host and publish this content under your brand on our domain. This content is indexed by search engines and may be referenced by AI systems. You own the content; we host it as part of the service. You may request removal of specific articles at any time by contacting us, though postedby.ai cannot control search engine caches or AI training datasets that may have already indexed the content.

Campaigns

Authority plan subscribers may activate optional promotional campaigns — short runs of 1–6 weeks published to social platforms in addition to standard weekly content. Campaign posts are published in your Champion voice. Campaigns are separate from and do not replace your weekly authority content. Campaign posts are not published to your blog. You are responsible for ensuring campaign content complies with platform rules and applicable advertising regulations, including any required disclosures for promotions, contests, or offers.

Contacts and Outreach Emails

The contacts feature allows you to store business contacts and receive weekly personalized email drafts based on your latest article. Drafts are generated by AI using your contact's name, company, and publicly available information about their business. You review and approve drafts before sending. When you send, the email is delivered from a postedby.ai sending domain on your behalf. You are responsible for ensuring your use of the contacts feature complies with CAN-SPAM, CASL, GDPR, and any other applicable laws governing commercial email. You represent that you have a legitimate basis to email each contact. Do not use the contacts feature for cold email at scale, spam, or any communication that would violate applicable law or platform policies.

Google Analytics 4 Connection

You may optionally connect a Google Analytics 4 property to your account. By doing so, you grant postedby.ai read-only OAuth access to that GA4 property. This connection is used solely to display website traffic and engagement metrics within your dashboard. You may disconnect at any time from your settings, which immediately revokes our access. You are responsible for ensuring that your GA4 property is properly set up and that connecting it to postedby.ai is permitted under your organization's data governance policies.

Platform Credentials

By connecting your social media accounts, you authorize postedby.ai to publish on your behalf using those platforms. You are responsible for the accuracy of credentials and maintaining valid access. You may revoke publishing access at any time from your dashboard.

Content Review

Clients have an opportunity to review content before publication. If no response is received within 7 days of notification, postedby.ai may publish according to the client's default settings. Clients are responsible for the accuracy of factual claims associated with their business.

Cancellation

You may cancel at any time by emailing hello@postedby.ai or through your account settings. There are no long-term contracts or early termination fees. Publishing stops upon cancellation. Content remains accessible for 12 months after cancellation. Onboarding fees are non-refundable.

Termination by postedby.ai

postedby.ai may suspend or terminate accounts that violate these terms immediately, and may terminate service for any other reason with 30 days notice. On termination, we will provide a data export where reasonably feasible.

Service Limitations and Disclaimers

• Availability is best-effort and not guaranteed.
• Third-party platform changes (API updates, policy changes) may affect publishing capabilities.
• AI-generated content may occasionally contain inaccuracies.
• We do not guarantee specific SEO rankings, AI citation visibility, traffic, leads, or business outcomes.
• The service is provided as-is without warranties of merchantability or fitness for a particular purpose.

Limitation of Liability

To the maximum extent permitted by law, postedby.ai's total liability will not exceed the fees paid by the client in the 12 months preceding the claim. postedby.ai is not liable for indirect, incidental, consequential, or special damages, or for actions taken by third-party platforms.

Indemnification

You agree to indemnify and hold harmless postedby.ai, LLC and its affiliates from claims arising out of your misuse of the service, content you provide, or your violation of third-party platform rules or these terms.

Intellectual Property

The PostedByAI name, postedby.ai brand, Champion concept, and service infrastructure are property of postedby.ai, LLC. Clients receive a license to use delivered content, but not the underlying service systems, templates, or methods.

Dispute Resolution

These terms are governed by the laws of the State of Colorado. Venue for disputes will be El Paso County, Colorado. Before starting formal legal action, both parties agree to attempt good-faith negotiation for at least 30 days.

Changes to Terms

We may update these terms from time to time with at least 30 days notice. Continued use of the service after changes become effective constitutes acceptance of the updated terms.

Miscellaneous

• These terms constitute the entire agreement between the parties regarding the service.
• If any provision is found unenforceable, the remaining provisions remain in effect.
• A failure to enforce any provision is not a waiver.
• postedby.ai may assign its rights and obligations in connection with a sale, merger, or reorganization.
